1. Acceptance of Terms
By accessing or using CardVault ("the Service"), provided by BreakToSurvive ("we," "us," "our"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.
2. Description of Service
CardVault is a trading card collection management platform that provides AI-powered card scanning, collection tracking, market valuations, and a peer-to-peer marketplace. The Service is available via web browser and iOS application.
3. Account Registration
You must create an account to use most features. You agree to provide accurate information and keep your credentials secure. You are responsible for all activity under your account. You must be at least 13 years old to create an account.
4. Subscriptions & Payments
Free Tier: CardVault offers a free tier with limited features (100 cards, 5 AI scans per day).
Pro Subscription: CardVault Pro unlocks unlimited cards, unlimited AI scans, marketplace selling, analytics, and more. Pro subscriptions are available as monthly or annual plans.
iOS In-App Purchases: Subscriptions purchased through the iOS app are processed by Apple and subject to Apple's terms. Payment is charged to your Apple ID. Subscriptions auto-renew unless canceled at least 24 hours before the end of the current billing period. You can manage subscriptions in your Apple ID account settings.
Refunds: For iOS purchases, refund requests must be submitted through Apple. For web purchases, contact us within 7 days of purchase for a full refund.
5. Marketplace
CardVault provides a marketplace for users to buy, sell, and trade cards. By listing cards for sale, you represent that you own the cards and have the right to sell them. CardVault acts as a platform facilitator, not as a party to transactions between users.
CardVault is not responsible for the quality, safety, or legality of items listed, the accuracy of listings, or the ability of buyers to pay or sellers to deliver. Disputes between buyers and sellers should be resolved between the parties involved.
6. AI Card Scanning
Our AI card scanner provides automated card identification and estimated market valuations. These are estimates only and should not be relied upon as definitive appraisals. Actual card values depend on many factors including condition, market demand, and authenticity verification that our AI cannot fully assess.
We do not guarantee the accuracy of AI identification or valuations. You should independently verify important card details and values.
7. User Content
You retain ownership of content you upload (card photos, collection data, profile information). By uploading content, you grant us a non-exclusive license to use, display, and process that content as necessary to provide the Service.
You agree not to upload content that infringes on intellectual property rights, is illegal, abusive, or violates the rights of others.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to access other users' accounts
- Scrape, crawl, or harvest data from the Service
- Upload malicious code or attempt to compromise the Service
- List counterfeit or stolen items on the marketplace
- Manipulate valuations or marketplace listings
- Create multiple accounts to circumvent free tier limits
- Resell or redistribute access to the Service
Violation of these terms may result in account suspension or termination.
9. Intellectual Property
CardVault, its logo, design, and code are the intellectual property of BreakToSurvive. Trading card images, player names, team names, and related trademarks belong to their respective owners. CardVault's use of these for collection management and identification purposes constitutes fair use.
10. Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.
Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Account Termination
You may delete your account at any time through the app's Profile settings. We may suspend or terminate accounts that violate these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.
12. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via the app or email. Continued use after changes constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of the State of California, United States. Any disputes shall be resolved in the courts of Ventura County, California.
